These General Terms and Conditions of Use (hereinafter the “CGU”) are offered by OuiGroup, a simplified joint stock company with a capital of 1000 euros, registered in the Paris Trade and Companies Register under number 814407208, whose head office is located at 23 rue de Prony 75017 Paris (hereinafter “OuiGroup”). OuiGroup is the owner and publisher of the OuiLive application (hereinafter the “Application”).
The purpose of these T&Cs is to define all the conditions under which OuiGroup allows users to use this Application (hereinafter the “Users”). Any User declares to have read and accepted these Terms of Use before using the Application. In the event that the User disagrees with one or more of the provisions of these Terms of Use, he is requested not to use the Application.
Before using the Application, the User must ensure that he has the technical and computer resources enabling him to use the Application, in particular ensuring that the computer configuration of his mobile terminal is in good condition and does not contain viruses.
OuiGroup implements all appropriate measures to ensure that the User has access to the Application, under optimal conditions, 24 hours a day, 7 days a week. However, it cannot under any circumstances be held liable in the event of unavailability of the Application due to an internet outage, bugs or operating errors making it impossible to access the Application. Access to the Application may also be temporarily interrupted in the event of maintenance operations.
To be able to use the Application, the User must first create a user account on the Application. It is the responsibility of the User to maintain the confidentiality and security of their login details to the Application. The User must immediately inform OuiGroup of any unauthorized use of their identifiers. OuiGroup cannot be held responsible for any loss or damage resulting from a fault or negligence on the part of the User in protecting their identifiers.
The User undertakes to comply with all the provisions of these T&Cs.
The User agrees that he only uses the Application for his personal use, in accordance with
these CGU. In this respect, the User abstains from:
To use the Application in any illegal manner, for any illegal purpose or in any way incompatible with these T&Cs. To alter or artificially modify the usage and performance data on the Application in order to artificially distort or improve the performance and results of the User and therefore the results/rankings of the challenges, To open more than one User account or to open an account impersonating a third party.

To infringe the intellectual property rights of OuiGroup.
The User is informed that OuiGroup processes personal data belonging to him via the Application. The processing of personal data by OuiGroup is more fully detailed in its privacy policy. The Application and all of its elements and contents are protected by copyright, trademark law, design and model law and/or all other intellectual property rights. All of these rights are reserved for the whole world.
No title or right to any element or software will be obtained by downloading or copying elements of the Application. It is strictly forbidden for the User to reproduce (except for personal and non-commercial use), publish, publish, edit, transmit, distribute, show, remove, delete this Application and the elements and software it contains, nor to modify it or to perform any work using these protected elements as a basis. The name and brand of OuiGroup or OuiLive, the associated creative challenges and concepts, the logos, designs and models, stylized letters, figurative marks, and all the signs represented on this application are and will remain the exclusive property of OuiGroup. Any use by the User of the above elements, corporate names, brands and distinct signs belonging to OuiGroup is strictly prohibited except in the case of the express and prior agreement of OuiGroup.

In the event of a dispute that may arise during the interpretation and/or execution of these terms and conditions or in connection with these Terms of Use, the User may decide to submit the dispute with OuiGroup to a conventional mediation procedure or any other alternative dispute resolution method.

In the event of failure of this mediation procedure or if the User wishes to take legal action, any dispute will be settled before the competent courts.
